Civil litigation tries to put the plaintiff (injured party) into the position they would have been in but for the wrong perpetrated against them. This is often done by awarding monetary compensation known as damages and in some cases can be remedied by way of injunction forcing someone to do or not to do something.
In many situations “costs follow the event”. This means that the winner of the case will have the majority of their legal costs ordered to be paid by the losing party. This can of course represent a “double whammy” for the losing party who not only has to pay his own legal fees but also the majority of those of the winner.
