Litigation or arbitration is not always the best option, or indeed the only option in terms of resolving disputes. Alternative forms of dispute resolution are now becoming more widely used and the courts often refer disputes to such forms of alternative resolution process before actually admitting them for formal litigation.
The benefits of alternative forms of dispute resolution are many. For example, such resolution processes are often (if not always) much more economical in terms of cost, and where successful, disputes can be resolved in a fraction of the time in comparison to court proceedings.
Clarke Jeffers also recognise that parties resolving their dispute through alternative resolutions such as mediation are much more likely to do business again or deal with each other again. Similarly, mediation in sporting disputes will be much more likely to result in the parties remaining together (for example, members of clubs etc)
